I 131 info

Just filed an I 485 and the whole shabang.....

I am waiting for my I 131 papers...But I need to go back to Canada for less than 24 hrs.

What are my options: I hold an EU passport in addition to my canadian passport, I also hold a canadian citizenhip card and a Nexus card.

I don't want to risk having to reapply all over again.

Help would be appreciated

Don't leave until you've got them, read too many horror stories on here where people have had to re-apply. Or don't leave, period, would be my suggestion. There was one guy on here the other day who actually had been approved for advance parole but because he didn't have the bit of paper with him at the POE when he re-entered they deemed him to have abandoned his AOS.

what about expediting the I131. What info can one provide to process it more quickly?

Make an INFOPASS appointment at your local district USCIS office, they *may* be able to expedite the AP. Or they may not. They'll want to see evidence of "emergency" need to travel. If you don't have an emergency, the liklihood of them moving it along for you is next to nil.

DO NOT LEAVE the country until you have the AP document IN YOUR HANDS! And DO NOT use an alternate nations passport to attempt to gain re-entry. You could be accused of fraudulent activity if you do that.

I see....I spoke to someone at the USCIS over the phone and he made it sound like a really easy process.....He said I could even send the petition (letter) with the pertinent info and they process it really quick. Not too sure who's right and who's wrong.

But at any rate, I will make the INFOPASS appointment.

Reba: When you say emergency...can you elaborate? I might need to go to Canada to finalize the sale of a business..does that count as emergency?

Not my call. I know of some people who were refused emergency AP and they had a family member at home dying, and they missed the funeral.

Reba...Thanks again!!!

When my wife got her Canadian Permanent residency n Canada, she applied as if she was living in the US. But we were living together in Toronto. We crossed the border and flew back and forth at least 10 times over the period over 5 months...Not one single time, Immigration Canada said a word. In fact, she used to say that she was still waiting on her papers...

I guess the US system is extremely strict when it comes to this!!!

Yep, they are. And I've seen stories about Canadians who left without AP and couldn't get back to the US and ended up sleeping on various family or friends sofas until they got some sort of marriage based visa.
