I-94 form question

For the past year I was on a TN Visa and it ended in June of this year. I returned back to Canada before that date and when I went to hand over the I-94 form the Canadian CBP officer refused to take it stating that it is not necessary and that he gets hundreds of these all the time and doubted the US ever looked at them...he said I should be fine...hence I kept the form.

Since then I went have attempted to go back to the states to get my TN Visa renewed and it was denied and I have now been red flagged.

I am going to be crossing the US border this upcoming week for a non-work related issue (going to write a professional licensing exam) and I am just worried that since they did not receive the I-94 form from before it might give them a reason to deny me again since they will now scrutinize me more than the regular person.

A couple of questions:
1) would it even show up in their system that the I-94 was not given?
2) since my passport barcode is swiped each time a border is crossed is that another way I can prove I crossed on the appropriate date?
3) if they ask me if I surrendered he I-94 form should I just say yes or be truthful and tell them what happened?

Any insight would be greatly appreciated.

That Canadian Officer is a dumb ass. We enter each and every I94 into the system. No I94 equals no departure. Our system will show you as never leaving the USA. Yes, we can contact Canada to find out when you left, but that is not for us to prove, that is for you to prove.
1) of Course it shows up, why else would we issue them.
2)Yes, but it's on you to prove you left, not us.
3)We can see that you did not turn it in, so lying just makes you look bad.

You will probably be fine, just tell the Officer that you tried to tun it in, but the Officer would not take it. This happens in the summer due to the fact that CBSA hires summer help, and they don't know diddly, they just think they do.

Man I am going to be sweating my pants off though...should I bring the I-94 with me including my old boarding pass when I crossed? The only thing is the boarding pass only shows I flew into buffalo...where I was picked up and driven across the border so it wouldn't prove crossing. What else can I do to make it go smoothly because I already have a denial for a visa on my record?

I am currently compiling bank statements and credit card statements and will write a letter as well.
I will bring the plane ticket as well just in case. Also I was supposed to leave by 6/1/11 and I was denied to the US on 6/20/11 so it clearly shows I went back to the US

Just hand it in. If you can show when you left it will be no problem. As I stated earlier, this happens when the "summer" help is working. I would not worry too much over it.

Khanoa, it takes several WEEKS for such a submission to make it through the bureaucracy and end up on the CBP system.

The key is to prove your Cdn ties, not prove that you left on time ... but still have no ties. Your denial of entry wasn't based on overstay -- it was based on lack of ties given you ahd just lost your TN.

You are getting way too excited about this.
