I-94_going canada for 4-6 month

Post Wed Jul 08, 2009 2:51 pm

Hi All,
I am on H1B visa status (before I was working on TN).
Due to shortage of work/projects in my company I am planning to go back Canada for 4-6 months from WA & Vancouver BC border.
What is the normal process, when I will move with my family and U-haul truck?
Either I surrender my I94 to Canadian officer at POE.
Or I just go US-office at POE and inform that I am going for unpaid vacation for 4-6 months in Canada or some personal issues??? and I will definitely come back on same job.
Please also reply Is any problem If i will comeback after 4-6month on same H1B- visa on same company???

If you're not working and leave the country essentially it's a layoff and that's the end of your status.

When they sponsor you on the labour certification they have to state what they're paying you, so if they stop paying you or pay you less, then technically you're not employed full-time and it's a layoff. There are specific DOL guidelines on this, have a poke around on the Dept. of Labor website.

Clearly if you're moving your whole family and your personal effects I find it hard to believe USCIS would see it any other way.

So you surrender your I-94 to CBSA (like it says on the back) when you leave and to bring your stuff back in you need to fill in CBSA forms B4 and B4A to declare them.
Steve.
