I am a canadian wanting to marry an american

Post Wed Apr 29, 2009 10:36 pm

I have met and fallen madly in love with an American man online! We talk on the phone and online every day! I am planning a holiday in July for his birthday and he is meeting me there! If we wind up getting married am I allowed to stay or do I have to come back to Canada to fill out the forms and stuff? As well what kind of forms do I need to fill out?
I have looked info up on line but I get so confused and frustrated! I know once I am in his arms I wont want to leave! Is there any way i can stay with him?

Someone please help me!!!

You haven't met him face to face yet, and you're planning to get married already? WOW!

For marriage based immigration information see http://www.visajourney.com ALL the information is there, including Guides and example forms, plus forums to ask questions of those who've BTDT. There is a Canada forum there as well.

Also, the forms are at the USCIS website (site seems to be down at the mo, or I'd link it for you. Just google "USCIS")

I wouldn't advise staying to get married. I would seriously consider doing it the legal way, return to Canada after your trip, and plan your wedding properly for when you can get the proper visa that will allow you to stay in the US.

Like reba stated, check out VisaJourney (VJ) It pretty much shows you step by step on how to file the paperwork, there is even pictures of already filled out forms, lol and of course you can ask all the questions you want for free. You don't have to get married, you can go for a K1 which is a fiance visa, it is usually quicker than the marriage (k3 or cr-1) visas, but there are negatives to it as well. here is agood link giving u the plus and minus of the 3 visas:
http://www.visajourney.com/forums/index ... ge=compare

Read over VJ, at the top of each forum are GUIDES, and there is a search feature as well, but its not the best, lol And there is a canada forum where most of us canucks hang out. Just a heads up--there is an off-topic forum, and if it can get pretty rude in there, I'm amazed on what people say, lol.

The visa process isn't that difficult, it really isn't, its just the waiting that is a pain. K1 take take anywhere from 6-8 months, and the k3 and cr-1 around 1 year. k3 was suppose to be faster than the CR-1, but normally isnt, thus it is sort of becoming the way of the Dinasuars. And yes you can visit while the process is ongoing. many of us did. yes you can be denied entry, but most do not have any problems. You wil see tha tquestions answered weekly on VJ,lol. Some odf the common questions are : Can i visit the usa? Where do I get a Canada wide background check? What kind of Birth certificate do I need, lol Its almost like ground hog day at times, everyone has the same concerns. Best of luck

If it's spontaneous and unplanned then legally you can apply for AOS from B-2 visitor. You don't have to return to get a K visa. Immigration consultants always tell you this in a sort of hint, hint way but in this case it sounds as though it could be legitimate, as you've never met him and he hasn't proposed.

Actually I think it's getting quicker because the number of applications has tailed off. The service centres are supposed to take six months max. plus you have the turnaround in the mail and the wait for the interview so it should work out to 8 months maximum but I know some recently who did it faster than that.
