If TN gets denied, can I immediately try to enter as B-2?

Hi all,

I have a job that starts in early January, and the earlier I can enter the US the better (to start application for SSN, etc.).

It sounds like the USCIS officers are pretty subjective with allowing "early" TN's, varying from 2 weeks early, to only the day of the job start date.

Note: I will be applying for a three year TN, so I'm not concerned about losing a few extra days by acquiring TN status early.

I have two questions:

- If I try to get the TN early (3 weeks early), and I get denied, can I immediately try again as a B2 visitor instead (I will be flying down to do apartment hunting for only a few days, and I WILL have a return flight already).

- If I get denied for my early TN, I will probably try to re-enter again at exactly two weeks before my start date. I will be trying for a three year TN. If they deny my three year TN (for whatever reason), can I immediately retry for the one year TN? (My employer will be providing both letters, just in case).

Bottom line: Does USCIS require a minimum wait time before re-trying for TN status?
