you can do the b2 visitor visa, then afterwards apply for tn by mail and use expediate service which would cost extra. i did it that way, who knows the officer at the border is in a bad mood that day if you try your tn then.

Yeah, the best way is to lie, and then adjust from within. Its better than being honest.

I will once again point out that Canuck Abroad in no way shape or form condones lying to US border officials. Comments made by independent members are their own, and do not reflect the opinions of Canuck Abroad.

I wouldn't recommend lying. It usually comes back to bite you in the ass sooner rather than later.

The first question asked at the border is "what is the purpose of your visit?"

If you answer "I've found a US job, but I'm circumventing CBP by entering as a tourist in order to immediately file an I-129 for TN, because I fear that I will be denied entry if I petition at the POE", then you won't be lying, you will simply be turned away.

If you do not answer exactly as above, you will be lying. Above all, POE officers are trained to detect catch and absolutely grill liars.

Don't lie.

My first thought on reading this thread was that the original poster does not understand that a TN is dependent on having already secured a job. Since this is the basis upon which the TN is issued it's implausible that you aren't going to perform the job, and go in as a visitor because you didn't get approved.

I guess my assumption was not that they were considering lying, just that wasa didn't understand. I guess I wouldn't cut it as a POE officer. :D

While we are on the topic of "lying". My advice is if you want to lie, then lie. Who are we to stop someone's choice of action. When they get caught and barred from future entries, they will know why they should NOT have lied in the first place.

I know people who have been barred 3 and 10 years respectively for lying to a CBP official about their intent here in the U.S. I'm sure now they have learned their lesson because while one is trying extensively for an appeal, the other has no intention on coming back because his experience was that horrible.
