Impact on my TN Visa

Post Wed Jan 07, 2009 11:12 am

I have been wanting to move to the US for work for a few years now, and have some job leads in New Mexico, Utah, and Colorado. My boyfiend of a year lives in Wyoming and I have visited him several times over the last year and have always told the border guards when I was going to visit him. It hasn't been a problem thus far. However I'm wondering if it will impact my ability to get a TN Visa?

If I get a job down there, I will be at least eight hours driving time away from his town. He will not be moving with me because his dad is very sick right now, he owns a house, and has a steady job. I will be looking to rent a room or share a place with people wherever I move to. Aside from the boyfriend thing, I do not anticipate any other problems with my TN Application. Please let me know your thoughts! Thanks.

The only problem that could come up is if they believe you don't have non-immigrant intent, which can come up if they think you're moving in with your boyfriend. But you're not so I wouldn't worry about it. They might ask you, but if you tell them he lives in another State eight hours drive away, I can't see why that would be a problem.

What if I'm only 1-3 hours away from him? Again I won't be moving in with him, but I would be a lot closer. This is more of a possibility.

It's entirely subjective and boils down to whether the agent you get thinks you have immigrant or non-immigrant intent. If you're not living together then I would say you have non-immigrant intent, but that's purely an opinion and it depends on their mood basically.

I have to say though plenty of people who've posted on here have gotten TN-1 at Edmonton, Calgary and Sweetgrass and CBP seem more laid back about it than back east or on the west coast so I wouldn't worry about it, good chance they won't even ask you if you have a bf in the US.
