Is there a time that is "too soon" to renew TN visa at PoE?

Is there a time period that is 'too early' to 'renew' (get a new TN for the same employer) at the PoE?

For example:
If my TN expires in early May, but the easiest time for me to go to Canada and come back over to the US is 5 weeks before the expiry, is that frowned upon, or typically met with any resistance?

Hi, I am in the same position and my company wants me to renew it 2 months early, does anyone about this, How early is too early.

I don't think there is any set time in law for it, however usually in non-immigrant classifications where you're going to a job they'll only let you in up to a week prior, so I suspect they'll usually do that with TN-1 as well.

Hi riked, any luck on renewing your TN 2 months early? I'm in the same boat and I've heard that it is possible but just wanted to hear from someone with direct experience.

There is no such thing as a "renewal", it's a re-grant, so if you leave, surrender your I-94 and then re-enter wanting it to be a new TN-1 you are applying for the grant again in the same way as you did initially. Obviously you can do that at any point, but if you have TN-1 status already you are giving up the remainder of it. You can't have the status start from the end date of your current TN-1. If you want to have it start from the date your current one ends, you're looking at around a week like I said above.

Where do I surrender my I-94? I'll be going through Terminal 1 at Pearson airport on my way back to the US. So when I go through customs do I just surrender my I-94 there and tell them that I am reapplying?

Furthermore, will it raise any red flags if I am reapplying for my TN even though my current one still has 2 months left? Or is it enough that I tell them that my employer would like me to reapply now since I had to go to Canada anyway instead of travelling again in 2 months?

Sorry for all the questions but I never know what to say to customs when they grill me.

If you are reapplying for a TN at Pearson (or any other POE), the CBP officer will just take the old I-94 and give you a new one when you apply.

I doubt this would be a problem. You would, of course, lose those 2 months on the old TN since you would have to get a new letter showing new dates (with your new "start" date being no more than one week from the date you apply for the new TN). Your new TN would start from the day you re-enter the US, not when your old TN expires.

I reapplied 4 months prior to expiration with no issues what so ever.
I did that so my Visa will expire around Christmas time, so I could consolidate my reapplication with seeing friends and family over the holiday season in Canada.

You're just ending your current Visa early which is not an issue with immigrations.

Just don't say "renewal" at the PoE, as it is not the right terminology and some immigrations agents do get angry if you say that.
