J1 W/ Criminal Record

Post Sat Nov 19, 2011 3:45 am

Hi there,

I have a charge of simple assault (which is not considered a CMT) that happened 5.5 years ago. Would i still be eligible for a j-1 visa or is it an instant no? I have been to the states 3x in the last year without any problems.

Entry on J1 is under the same criteria and tourist. If you have been liet in up tl now, there is no reason to think that you will be denied entry on J1. CMT as a definition applies only to green card process.

All submissions to CBP USCIS should be considered as being given under penalty of perjury. If they as something, you answer truthfully.

O the application if it asks if you have ever had a criminal record,, one has to answer it honestly! If they find out you have lied, it will not end well!!

It's not a CIMT. And it does apply to all who want to enter the United States. It has nothing to do with a green card. Simple assault is NOT a Crime Involving Morale Turpitude, so you should disclose it as it will make no difference in your application.
