K1/K3 Poverty Guideline Question

Hey everyone!

I'm new to posting here, but I have been reading for a while because I'm interested in marrying my American boyfriend and living in the US.

I have a quick question about the K1/K3 visa poverty guidelines -- basically, is there any way to get around this? I think this would mean that my boyfriend needs to make somewhere around $17,500. He runs his own business, and it's still fairly new, so it doesn't make that amount yet. That said, he also has no expenses other than a $100/month student loan payment, and a $35/month car insurance payment. He lives with his parents, as we intend to do when I move there as well, until we've saved enough money for us to get our own place (without renting). If he were to get an affidavit or something similar stating that he makes X amount (looks like it's going to be about $10,000 this year, maybe more), and has only those two expenses, and that he lives with and is supported by his parents (they pay for groceries and stuff, too), is that a way to prove he can support me as well?

I mean, he's starting up two more businesses next year, so it won't be long until he's making the minimum, but we're just sick of waiting so long as it is (we've been seeing each other for nearly 2 years now). So yeah, we're just wondering if there's a way to jump around that.

His parents seem willing to support him. Maybe they will support you too.

Its called co-sponsorship; they sign that they would be on the hook for you, just like they would be when they co-sign for his next car loan. Those guidelines are there for a reason.

Unfortunately the USCIS are quite firm in their rules about the affidavit of support. If the sponsoring US citizen cannot prove sufficient income, the application for immigration will be denied.

ask If your boyfriend's parents will co-sponsor you.
