L1-A ELIGIBILITY

Hi there,
I need advice on whether I am eligible to apply for an L1-A....have been told several times that I am but another opinion wouldn't hurt.
I was on H1B visas from Feb 2003 to Feb 2009. Then was on a E2 spousal from March 2009 to Nov 2009 but did not work in the US at all. Was pretty much going back and forth to Canada to overlook my business.
After that I was completely out as of Dec 1/2009.
My canadian business was opened in 2008 and had a manager run it when I was out. We are now opening a new business in the US which I will be managing on a day to day basis and hiring staff etc etc. Of course the canadian business will remain intact...we have a manager who will run it.
I have ownership of both companies and docs to prove it, business plans are ready, financials, tax returns etc etc...

Any advice is appreciated.
