L1-A wanting to stay in the US...PLEASE HELP!

Hello All,

I moved to the USA less than a year ago on a L1-A visa. The Company I am with has feel on hard times and may not be around in the next year. I want to stay living and working in the US and I was wondering;

a) What are my options?
b) I am here as a Manager but don't have a degree in anything, is this a big issue if I want to get a TN-1 visa?
c) I have another company that will hire me but can they and how?

If you have no degree then you don't qualify for TN basically, and if the company that has sponsored your L visa lays you off, you have to leave the country and back to Canada.

The advantage of L-1 is that you don't need a degree to get it; the downside is that the other similar categories do (or equivalent), so you if try and get a job elsewhere you need a degree (and the job must require it).

I can't see many options here, there is no TN-1 category for manager even if you had a degree (although you might be able to fit into another TN-1 category), and H-1B isn't an option either because of the quota. "Management Consultant" is what most people try and use but USCIS are pretty tough on that category and interpret it narrowly, i.e. BA or five years experience consulting and it must clearly be a position consulting to management, not management itself.

I have to say I was in a very similar position years ago and I ended up leaving. It was either that or get married!
