Hi, Need some advice please... Had initial L1A visa in 2010 which was approved...applied for extension after 9 months...RFE was requested and then visa was denied. Attorney really messed up file. The L1A visa expired on Aug 29/11 and got new attorney which refiled new application post marked on Sept 8th (10 days after initial L1A visa expired). Then received RFE which attorney responded to within the time requested. My husband had the L2 initially and when we refiled he was on application as well. Waiting for reply from CIS but my husband just received notice that his extension of stay was denied even though letter mentions that the I129 (my L1A file was approved). Really confused about this. I have not received the approval notice yet the notice mentions that the visa is approved and that both me and my husband's extension of stay is denied. Our attorney says that after I receive the approval notice that we need to go out of the US and reenter to get stamped with a new I94 card. My questions are: 1) What does this mean exactly and why was the extension denied..letter does not specify. 2) How long do we have to leave the US after I receive notice ? Do not want to overstay for even 1 day as we have always respected our dates and the laws. 3) Will we have any issues reentering the US after we leave ?
Any advise is appreciated..our attorney is wonderful but want to make sure were doing everything correctly. Thank you so much.
Thanks for your reply...I'm understanding this better now however will we be considered as overstayed ? The expiry of the visa and initial I194 was on Aug 29/11 and new application was filed 10 days AFTER and we've been waiting for file to be adjudicated and finally got the approval after 224 days but with a denial of extension of stay. My spouse's letter states that the extension of stay has been denied and is without status because of the denial and must leave but no date of departure is specified. My spouse is ready to depart after receipt of this letter but I have not received the approval notice yet. Should I just wait for the approval notice first and depart right after and then reenter with my new approval notice ? Will my spouse have any issues reentering after receipt of the letter ? Thanks again
Thanks for your reply... Does the clock start from the date of the denial notice pertaining to the first L1A visa filing which expired on Aug 29/11 or is it from the denial notice date from the extension of stay from the 2nd approved application filing..this is what's confusing..
Noted we are waiting for the approval notice and definitely not working...just do not want to overstay as have never overstayed not even for a minute..
