Landed Immigrant by Spousal sponsorship, Indian passport.

Hi,

I currently have a company willing to employ me and has hired a lawyer to go through the necessary process to bring me in.

I hold a visit visa to the US, I have a passport from India and I'm a landed immigrant in Canada (currently living in Canada as well). I recently went to the US about 3-4 times and now the US customs is not letting me in because ofcourse they suspect I might start working without a proper visa.

Hence, I'm waiting for the US company lawyer to get going. However, I thought it'd be good to know for myself as to what the process is going to be like and what kind of options I have from a community like this.

Please advise.

If you've been denied entry that might cause you problems in the future, however Indian citizens need a visa and there are less options available than for Canadian citizens (such as TN-1). What you're looking for is something like H-1B which is subject to a quota.

If you move to the US and you're married to a Canadian citizen your LPR card will remain valid but you won't be able to qualify for Canadian citizenship. Plus it also can cause a bit of a mess with your taxes, because technically if you are claiming to be a permanent resident of Canada you have to file taxes in Canada as a resident.

Thanks for bringing up the taxes part. But that's after the fact of going to the US.

I still need help in figuring out the visa stuff to begin with. Apparently one of the lawyers said that even if I do get ____ visa, I'd still have to wait till September to fly there. So I didn't understand what that meant.

He's talking about the H-1B lottery. Have a look at the USCIS website.
