Legal permanent resident application affecting student visa?

Post Tue Nov 11, 2008 9:47 am

Hello,
I have a question regarding student visas. I am planning on attending univeristy in Texas next fall. I am a canadian citizen and my mother is a legal permanent resident of the US but living here in Canada right now. We are planning on submitting an application for her to sponsor me for my green card and I am aware this is will take a long time to get processed. My concern is this.if I have an application in for legal permanent residency will it affect me getting a student visa to attend school in Texas in fall of 09?

Thanks in advance,

No, you can enter in a non-immigrant category while you have a petition pending. It's when the petition is approved it gets dicey, but that takes years.

How is your mother a US permanent resident if she is not actually living in the US? If she stays outside the US and takes up residency in another country, she loses her status in the US.
