Living in Canada working remotely with the US

Post Fri Jun 17, 2011 8:28 am

I am currently employed by a company that has offices in the US. I have a multiple year assignment working directly for one of our US offices. I still live in Canada(no residence in the US) and am paid by my home office in Canada. My costs are 100% charged back to the US office during this assignment. (wages and travel). I am in the US usually about 8 days a month.

I have an L1A visa for this assignment but my question is whether this is needed.

For the time spent in US, you may need the L1a. It does make it easier for you to cross each time, rather than have to re-prove a business visitor entry.

It makes no difference for you in terms of taxes, etc. You remain a Cdn tax resident and are not taxable in US (so long as you don't spend significantly more time than the 8 days per month.

It would be good for you to carefully track each day spent in US, to avoid any surprises (ie. if you stay more than 183 days in any rolling 12-month period, you could have some tax reporting issues).

On the other hand, if you were thinking of moving to the US side of the border, your L1 allows you this.
