I agree. Sorta....

Think of it this way:

I steal a pack of gum from a store, and the store suspects that I did it, but doesn't know for sure, so they spend an hour grilling me about it. During the entire hour I deny stealing it and swear Im inocent, until they look in my pocket and find the gum. Now they are pissed, and it becomes more about me lying to their face than about the $1 pack of gum. Now over a little pack of gum they call the police instead of just telling you to get out of here and don't do it again.
They were not honest and got the book thrown at them for something that I personally don't see as a problem if you are up fron about it.

Did that make sence? Im kinda tired from working a double.

Lol... I hear what you're saying.

But pardon my slowness,,, Where in the article did the couple lie to immigration officials? Did I miss something here? Maybe I'll read it again. I was under the impression that the couple told the truth and are still being penalized in a way for their past. (Well, the husband's past) and the wife's frequent trips to the U.S... I mean they are stuck between a rock and a hardplace overall. Maybe it was the wife not mentioning she married a citizen when they had discovered her marriage certificate????

Lets just say, I know the whole story. The media is leaving out details.

as usually happens of course. They spin it to their own purpose, and fo this purpose it would seem the media is attempting to pose Homeland Security/USCIS and CIC as Big Bad Government, with rules that are just not fair to loving, sort-of-law abiding citizens.

Same as when the media spun all those stories about US soldiers jumping the border to claim refugee status in Canada. And then try to show CIC as evil big government again for not allowing them to stay.

etc etc etc and yadda yadda yadda...

I guess from a Journalism perspective, you will have bias'. So I can understand if certain details were left out to make the appearance Immigration is in the wrong.

My problem with US immigration is this thing about being arrested for an indictable offence. Having travelled around the world that has a very different meaning in some countries than others. In some countries for example if someone gets murdered the police can just arrest pretty much anyone they fancy or do a dragnet so they can draw blood, take fingerprints etc., there is no probable cause. So then that means you've been arrested for murder even though in the US you would never have been considered a suspect. So what do you say to the question: "have you ever been arrested in relation to a crime of moral turpitude?"

Bear in mind most countries don't have habeas corpus even, grand juries were abolished in the UK I think in the 1920s.

Being arrested means nothing if there are no charges pending. The question should be, "have you been arrested for a crime for which charges are pending" or something like that.

How many people are there in this country that have immigrated from places with crappy criminal justice systems like China?

Yes I agree they should alter this question when asking in reference to criminal history. Getting arrested holds no barring as to whether you've been charged..etc

I have never heard that question asked.

Being arrested or detained has nothing to do with being inadmissible. A conviction is needed, not just merely an arrest. You can be charged for muder 10 times but if there is no conviction, there is no crime.
