This is illegal, there's been a lot of fuss about it at Blaine POE in particular. The United States, Mexico and Canada have agreed a treaty that makes a provision for it. An American can do a NAFTA listed job in Canada, a Mexican can do the same thing in Canada, Canadians can do the same thing in Mexico or the US, that is what the treaty provides for (free trade, free movement of labour).

That's one of the reasons there's no DOL certification for TN-1.

Steven is correct. There is nothing about stealing a US citizen's jon on TN. That was the whole purpose of NAFTA. In fact, even H1B, you don't have to prove that no US person can do the job.

@lawsrlaws - You raise a valid point that you have ask questions to ensure someone really qualifies for a TN. You are unfair in your tone however in claiming that a Canadian can take a US citizen's job away for $56. Using such a thought framework, how many Canadian citizens' jobs are 'taken' away by Americans who work in Canada on TNs? (I personally know quite a few!) Please be fair and not use Canadians or NAFTA as scapegoats for the economic problems in the world, which I am sure you are aware was caused largely by American financial institutions making mortgages available to people who should not qualify for mortgages in the USA, and by Americans who took such mortgages when there's no way in hell they could afford such mortgages.:)
