Management Consultant going for a 3 year TN- Please advice

Hi there,
This week I'll be going in for a 3 year TN visa under Mgt Consultant title at one of the POE near Toronto (haven't decided which one yet). I have held numerous TN visas in the past and have experienced my share of crap from custom agents. Having gone through these experiences I think I think I've leant a lot about the interview questions so I feel confident on that. However, this would be the first time I am applying for a 3 year TN, so I am a bit nervous they may take that as I am trying to fill a Perm job even though I am going through a recruiter who is paying me hourly and will send me to differnt client sites throughout US.

Can someone who has experience in getting a 3 year TN advice me on the following please?

1)What type of questions did the agents ask in respect to a 3 year Mgt Consultant TN request?
2)Is there anything in particular I should put or omit in the cover letter in respect to a 3 year Mgt Consultant TN request?
3)Also is there a particular POE you'd recommend for a 3 year TN?

Ummm...If your a legitimate Management Consultant, what are you worried about? There is no difference between a 1 or a 3 year TN. The process is the same.

Experienced your share of crap?

Did you know that the Management Consultant TN is the most abused form of work authorization?
Did you know that on this site alone, at any time, there is somebody asking for help on how to obtain a Mngt. Conslt. because they don't actually qualify.
Did you know that you get to take a US Citizens job for only $50 for three years.

But to answer your questins:
1) We ask the same questions. If your legit, there is no problem.
2)What would you Omit? Just make sure the letter states they want you for three years, not one. If it doesn't say 3 years, you only get 1.
3)Any POE. We all have good and bad Officers.

Again, if you qualify, why would you need to Port shop?

From the manual:

(G) Management consultants provide services which are directed toward improving the managerial, operating, and economic performance of public and private entities by analyzing and resolving strategic and operating problems and thereby improving the entity’s goals, objectives, policies, strategies, administration, organization, and operation. Management consultants are usually independent contractors or employees of consulting firms under contracts to U.S. entities. They may be salaried employees of the U.S. entities to which they are providing services only when they are not assuming existing positions or filling newly created positions. As a salaried employee of such a U.S. entity, they may only fill supernumerary temporary positions. On the other hand, if the employer is a U.S. management consulting firm, the employee may be coming temporarily to fill a permanent position. Canadian or Mexican citizens may qualify as management consultants by holding a Baccalaureate or Licenciatura degree or by having five years of experience in a specialty related to the consulting agreement.


So you need to fit into that to get it. And the job offer letter needs to explain why.

I know a lot of people who happen to be very senior Mgt Consutants and have been intemidated by the border agents because it is a title that has been abused often. However, that does not give border guards the rights to threaten or abuse the applicant ("grilling"). Anyways, my worries over applying for a 3 year visa is, given the high rate of unemployement in the US, they may view this as you are stealing away a US citizen's job and refuse you entry. If you have successfuly obtained a 3 year TN for Mgt Consultant, aside from ther TN cover letter and Contract matching a 3 year term, is there anything else one should make sure the cover letter/ contract covers?

I disagree. If the Officer didn't "grill" the TN applicant, than how would he know he is not pulling one over on him. If we were mind readers and no one ever lied, this would not have to be so. Sorry we have to take that approach, but do you have a better way? Besides just stamping in everyone, because there is no dishonest people out there.

"Stealing a US job" Umm....that exactly what it is. Think about it. Do you honestly think that out of the 330 million people in this country there is no one that is capable of filling your Mngt. Cnslt. job. Get real.

With that said. There is no way that an Officer could prove that anyways. Never seen it done.

Just apply and be honest. Im sure if you qualify, there will be no problems. The only difference in the letter should be the 3 year date. It seems you will be working for a Consulting firm, if so, its an easy TN for Officers.

I recently got my 3 year TN visa as a management consultant, I have to say - it was easier than I thought. I had all my paperwork ready and various documentation, and i was able to support what I'm going to be doing for the company etc...and I didn't have any problems!

As lawsrlaws says, if you're being 100% honest, there really shouldn't be a problem.

This is illegal, there's been a lot of fuss about it at Blaine POE in particular. The United States, Mexico and Canada have agreed a treaty that makes a provision for it. An American can do a NAFTA listed job in Canada, a Mexican can do the same thing in Canada, Canadians can do the same thing in Mexico or the US, that is what the treaty provides for (free trade, free movement of labour).

That's one of the reasons there's no DOL certification for TN-1.
