Marriage Visa and Home Visit Advice PLEASE HELP

Post Mon Feb 28, 2011 1:29 pm

I've lived in the UK for over 3 years now and my passport needs renewed now. I have plans to visit my parents at home at the end of June so everything should work out time-wise that way, but I noticed at the same time that my spouse visa is up at on the 9th of June!

I'm confused with what to apply for next since our 2 year probationary period is up, but now that everything overlaps I'm even more baffled. Can anyone advise me the best way forward? Should I stay in Canada longer so that I can send for my next visa or can I extend this one before I go so that I have my passport in order to travel??

Thanks very much for reading, any guidance would be greatly appreciated!

~Cassy

EDIT: very nervous about this so I've been reading up all sorts of things. If I need to file for ILR I can only do it 28 days before the expiry of my current visa or be refused and I have to be in the UK to do so. And in all likely-hood have to send my new passport away for that any way, which would leave me stuck here during my planned visit home... I really hope there is an extension process I can do sooner?

You can indeed apply for ILR 28 days before your qualifying period expires, but you have to apply before your visa ends. The qualifying period for spouse visa holders is 2 years. The start of your qualifying period is either the date of issue of your spouse visa or your date of arrival in the UK, whichever is later. So be careful when calculating your qualifying period.

You will also have to apply from within the UK. You can either post your application, which can take up to 6 months, or submit it in person at a PEO to have it processed within one day. Since you need your passport for June, we would recommend that you go for the second option. The fee is a bit more expensive (£1,250 instead of £950) but it's definitely worth it in cases like yours.
