Married couple returning home at different times

Married couple returning home at different times

After 8 years overseas, my husband and I have decided to move back to Canada. I plan on going to a professional school for additional training, and while that is starting in September, my husband will not be moving back until early 2011 as he needs to settle things with his company. As both of us have been deemed a non resident of Canada, does anyone know how my returning home early will effect my husband's residency status? Would it help if I declared myself as returning home as a non resident student? Any tips would be greatly appreciated! :)

As long as your husband remains outside canada AND (important) is living and working in a tax treaty country, he should be able to continue to be non-resident while you become resident.

He should rarely visit you if at all however during this period.

Both you and your husband are entitled to bring your household effects back as returning residents up to a limit of 10k cad per item. when you come back you should declare upon arrival...check out my site for the details...then when your husband returns he should make his own declaration. So long as his place of residence is outside Canada and he can prove this there is no issue how many times he visits you. Proof would be a letter from his employer, employment contract, lease/rental agreement, bank statements, utility bill etc...

I am customs officer...there is nothing to be concerned about. you returning early is fine...this happens quite often.
