Marrying a UK Citizen in Gibraltar: Does this help?

Marrying a UK Citizen in Gibraltar: Does this help?

Hello, I am a Canadian Citizen that has been residing in the UK for almost 2years now on a Working Holiday Maker visa.

While here I have met someone and we would like to get married. However, this October (2009) I have to return to Canada as my visa expires.

I want to reside in the UK and move here permanently to be with my boyfriend. I understand that in order to do so I need to return back to Canada and apply for another Visa or apply to be a permanent resident. But this is near impossible in my situation because I do not have a stable job in the UK (in order to apply for a work visa) nor does my partner have a stable job or money or residence in order to sponsor me for a Fiance visa. (we are self-employed musicians and artists so we stand no chance of stability in the eyes of immigration).

Since, my boyfriend is a UK citizen and we would like to get married I was wondering if we got married in Gibraltar and returned to the UK would this help my cause in terms of staying in the UK?

In other words, if we were to wed in Gibraltar, does this mean that I can stay in the UK? Does it at least mean that it would be easier to get a Marriage visa?

I would appreciate any advice

it does not change anything that you get married in Gibraltar, you still have to apply for your wife visa (or fiancee) from Canada.

Even on a wife visa you still need to be sponsored by your boyfriend so the best would be for him to find a full time job, once you have your visa he doesn't have to stay in that job.

You do not really have any other choice than to return to Canada to apply for another visa as you are on a Working Holiday Maker visa you are not allowed to switch to another within the UK.

Thank you for your reply. But gosh......it doesn't sound too promising for us now does it?

Do you know if it is any easier if we get married in Canada and then return to the UK to live?
