Marrying an American in Canada; returning to USA

I think have a fairly straight forward question...

I am a Canadian citizen and US permanent resident since 2000; currently living in the US.
My fiancee is a US citizen.
We are planning on getting married in New Brunswick next summer and will return to the US after; we have no plans of living in Canada immediately after the wedding.

Are there any immigration issues with this? Will Canadian immigration hassle us, thinking that our intention is to live in Canada after the wedding? What sort of documentation do we need to "prove" that we are returning to the US afterwards (we are both grad students and could easily get letters of enrollment)? We traveled together across the border last summer to visit family and got hassled at the border about our relationship and whether our intentions were to get married in Canada while we were there. I want to make sure that when we do cross the border to get married that there aren't any problems.

If your fiancee has proof of ties to the US, there shouldn't be a problem crossing the border. Bring evidence that you in fact will be returning to the US. Letters of enrollment from uni, proof of abode (copy of rental agreement), and your green card showing you have legal presence in the US should do it.

It's lawful to enter Canada (or the US for that matter) to get married. I suppose it may be helpful to have some evidence you intend to return to the US such as a return ticket. The LPR card should do it though.

Hello,

I have a similar situation... although maybe a bit more complicated.

My bf is a US citizen, I am Canadian. We met in Canada while he was there on a student visa for his PhD. We've been together 5 years now.

Currently, he is back in the US living in New Orleans for his post-doc, and I am living in Australia for my PhD.

My question is that we would like to get married and live in the US. The marriage would be in Canada though. If we get married in Canada, can I just submit an application for a K3 visa or is it more complicated than that?

My concern is that many of the posts and websites indicate that you have to prove you've been together for a certain amount of time etc. With us living so far apart, we only see each other once a year - but that doesn't mean we aren't fully committed to each other.

Any advice?

k3 is pretty much gone the way of the dodo bird!! Cr-1 is a far superior visa and costs less and has work authorization right from the start!! k3 does NOT have work authorization and costs more!! at 1 time the k3 used to be faster to obtain, 99% of the time, that is no longer the case, so no reason to go the k3 route!

I'm a canadian. My fiance is american and works a nurse in Washington state. She just finished her nurse's residency and is locke into a 2 yr contract which would be cost prohibitive to buy out of. additionally she has a teenage son still in school.

There is not an overabundance of job oportunites in her area of the country. I currently work in Fort McMurray and earn pretty descent money with a good rotation ( 7 days on/ 7 off)that allows me the currently travel back and forth to the USA , spend lots of time with her and her son and still make a comfortable livin have a good life.

We would like to get married in Canada sooner rather than later, and are leaning more towards ultimately living in Canada here when her contract is up and son finished of school s there are lots of nursing jobs here.

e have serious concerns that if we do this, and even with proof of employment,earnings and work schedule , history of travelling back and forth, etc that once we are married I may be denied entry into the USA as I may be viewed an an impending immigrant. We don't want to be apart and I'm free to travel back and forth so long as she is 'just' my girlfriend now, but we are committed to each other for the long haul and desperately want to tie the knot. I don't want to financially burden her by her having to support me as well as her son for untold months awaiting a visa either. That seems unrealistic to expect that as a sign of love.

Is there anyway I can expect to continue to work in Canada and travel to
the USA to see her in my offtime without getting turned back at the border should we get married n Canada???

When visiting the USA, ensure you have evidence with you that you will be returning to canada, such as return airfare, house lease/mortgae, letter from employer stating they expect you back on such a date, utility bills, etc etc ! And yes even with that, the POE officer can still deny one entry! I travled monthly to DC from NS as a married guy to see my wife, never had a problem, but some do--what it all boils down to is how you handle yourself and the POE officer. A simnple slip of the tonge of saying "live", vice "visit, can ruin ur day,lol. My simple advice:

1) Always tell the TRUTH. never lie to the POE officer
2) Be confident in ur replies
3) keep ur response short and to the point, don't tell ur life story!!
4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!
5) Pack light! No job resumes with you
6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)
7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!
