So you've not only been living illegally in the US for 5 years, you've been working illegally as well?

btw, I think your lawyer gave you some bum information, you should have filed for adjustment of status as soon as you were married, regardless. Which is neither here nor there.

You'll have to sponsor your wife to be able to immigrate to Canada, and you will have to show that you will have a job and place to live, however, there you cannot be denied a sponsorship application based on income. Income requirements are waived for spousal sponsorship.

Check out the forums at http://roadtocanada.com for info on the sponsorship and immigration application process. If you file what they call outland it usually takes about 6 months or so til she will be able to "land". However, with your history of being illegal in the US, I don't know if that will hinder your process or not. Maybe, maybe not.

Basically you move back, present a completed CBSA Form B4 and B4A at the border to declare your personal effects. You can sponsor your wife for immigration: http://www.cic.gc.ca/English/immigrate/ ... spouse.asp

Not filing taxes means the IRS will come after you, the first thing to do is to get hold of the CRA now and tell them that you left the country on whatever date (31st December of the year you left) so they aren't left wondering why you haven't filed a return. Then when you re-enter you then start filing again.

I suppose it's one way of simplifying the movement of your tax home out of the US, but obviously what you should do is file tax returns in the US for the years that you've lived there and pay back taxes and penalities.

Check out the information at Road To Canada. They're a lot more knowledgable about Canadian immigration process than we are here.
