Moving my children to the USA

Hi,

I am a US citizen who has been living in Canada basically all my life. I would like to move to the US, and I understand that my wife needs a green card to move with me, but what about my children? Do they need to get green cards as well?

FYI: I didn't live in the US long enough for the kids to have US citizenship transmitted to them automatically.

Yes, your children will need green cards as well.

The differnece is that immediately after getting the GC's (and living in US), they will automatically become US citizens, under the Child Citizenship Act of 2000, while your spouse will need to wait the normal 3 years before she can apply for naturalization.

But they do first need to get GCs.

Married under 2 yrs is the cr-1, 2 yrs and over is the IR-1. Up until this August their was a Direct consular filing (DCF) option in canada, that is NO longer an option! have a look at the above links.especially the 2nd and last link!

It is NOT a fast process, can take up to a year,sometimes quicker, sometimes longer!! paperwork is not that hard, its the waiting that sucks! You will see a k1 forum, but thats for unmarried people--fiance visa!1 K3 is gone the way of the dodo bird! Best of luck
