Moving to NV

Post Thu Oct 21, 2010 2:29 pm

My family and I would like to relocate to NV. We currently own a business that is incorporated in AB for our Canadian and run all CDN sales through that. We are also incorporated in NV for our US customers running all US sales through that company. It is an Internet based business. We are both the owners and primary shareholders. Would we be eligible to relocate under an L1 visa and therefore work our business out of the US instead of Canada?

Also, I am a Certified Payroll Manager (education certification granted in Canada, 2-3 year program). Through the business I am doing payroll consulting for US based businesses needing Canadian expertise. I am also certified on the US side with their designation. Would this fall under a TN visa - Accounting?

To get L1, you need to maintain the business in canada while getting the other one going in US, so, no, you are not eligible for L1.

An E visa, requiring lots of money and job creation would be your only bet in that avenue.

You would better be suited for management consultant that Accounting -- since you do not have a degree.

That all makes sense thanks! 2 questions, If we still keep our Canadian Company active (running all CDN) sales through it as it is now, would we then be eligible for the l1?

And, if I apply for the TN as a management consultant, can my own company in the US sponser it? We have a EIN.

You can get L1 if you set up a subsidiary company in US, but you will not be able to get TN, as this would be considered self-sponsorship, which is forbidden on TN.
