Moving to the US, Wanting to take Children

Post Thu Sep 08, 2011 7:36 am

Ok to give a brief run down of my situation. I am a single mother of 2 children, my 1st son's father is not involved but my 2nd son's father is. I have known a guy from Virginia for well over 8yrs now and we have been dating since the last year. I know he's my soulmate. He proposed to me a few weeks ago, so a wedding is in order. The question that I have is that, I have Sole Custody and full decision making control in the life of my youngest son. When I finally pack up and move, and my children have been applied for in regards to Visa's, What are the stumbling blocks that will deter me from taking my children with me, especially my youngest? What will I face in regards to access with my youngest son's father. I am willing to negotiate access arrangments from anywheres to summer access, a week in march and christmas breaks to allowing my ex every other year access (where he has him 1yr, I have him the following.) Is there anyway He can prevent me from leaving if I have sole custody?... Any information or any of those who've gone thru this situation and the outcome was successfull will be greatly appreciated.. Thanks for your time.

Sole custody does not mean you can move unilaterally. The father will have to agree to any move you make away from him, inside or outside canada.

For US, he will have to provide you with notarized document allowing you simply to cross the border, never mind live there. There WILL need to be an agreement.

He cannot prevent you from moving; he might be able to prevent the child from moving however. Lawyer's may need to get involved if you are not able to negociate an agreement.

maybe your "soulmate" (your third one, apparently) can't live without you... andwill move to canada?
