Multiple TN vs. multiple employers

Post Sat Jul 04, 2009 10:07 am

Hi there. I've heard that you can apply for multiple TNs, but I have also heard that you can have multiple employers on a TN. So for clarification, does this mean you apply for more than one TN for each employer? Or, is it ONE TN under more than one employer?

I'm trying to get TNs for two part-time jobs. One job is in California and the other is in Colorado. Will this adversely affect my application?

Thanks in advance for your response.

How it works is you get TN-1, and then the other employers each file an I-129 and you get TN-1 again to work for them.

The most common scenario is when a doctor or a nurse works for multiple hospitals or HMOs for example and each employer sponsors the employee individually.

You can go back to the POE (because it's cheaper if you live nearby) and apply there for additional TN-1s also.

So, to be *super* clear, I get ONE TN. And the I-129 is filed by the second employer to be added on to the same TN? i.e. only one piece of paper stapled to my passport?

Can this all be done at the same time in one border-crossing?

You need one TN per employer.

If you have 3 different jobs with 3 different employers, you need 3 TNs.

If you only work for one employer, you only need one TN.

You get one TN per employer. You don't need to do the I-129 thing -- you can get all of the TNs all at once at the border.

The other thing I would mention is that CBP have come up with a bizarre interpretation that additional TN-1 authorization must only be for a part-time job. So the job offer letter must say "part-time" for the other jobs. There's no legal definition of "full-time" or "part-time" and TN-1 was designed for cross-border workers anyway which implies that working in the US could be part of the time in a full-time position or part of the time in multiple positions so this opinion of theirs makes no sense to me.

For example I knew a doctor who had multiple TN-1s, he worked full-time in his own practice and full-time at a hospital. The number of hours he worked varied from week to week so one week he would be full-time in one job and the next week he would be full-time in the other.

And there's no particular legal reason why you couldn't work 40 hours in one job and 40 hours in another, but one of them apparently has to be described as "part-time".

Full time an a part time basis. I have never required it. Nurses coming through my port all have 2-5 TN's at any one time. I have never seen a problem involving the part/full time wording.

Full-time on a part-time basis?
