Must my job offer be temporary?

Hi there,

If there is already a thread about this, I haven't been able to locate it -- my apologies.

I have a job offer in the States, however it is not officially a "temporary" job. I read that as of 2008 the job offer must be temporary in nature (under 3 years). Is this true, and if so, is there a way for my employer to phrase the letter such that it would be acceptable at the border?

Also, will a job offer letter that clearly outlines the required information be sufficient at the border, or is it important for the employer to write a separate letter for the TN visa process?

The position itself need not be temporary. However the request for you to fill that position must only be for 3 years (or less) at a time.

Rarely does the offer sheet contain the required information that would be found in a proper TN letter: TN category sought, duties, and time period.

The TN itself is a temporary permit for the admission of Free Trade Professionals into the U.S. but the position does not have to be temporary in nature.

A job offer letter and TN petitioning letter are two different things. An offer letter merely validates your reception of an employment offer. A petitioning letter is actually your application for TN Immigration Status at the border in which you receive work authorization and an I-94.

So you will have both of these documents but it is important to distinguish between the two. A job offer letter by itself will not be sufficient to receive your TN or work authorization.
