My situation

Well I am in need of a bit of info, regarding US citizenship and residence. I am a Canadian Citizen and I also live here in Canada. My boyfriend was born in America and moved here and grew up till he moved back on his own almost 5 years ago. He doesnt however live there permentaly, he goes back and forth from Canada to US, he only stays there during the winter and fall. He is now in school there, I am currently pregnant with a girl and entering my third trimester. I am aware that she will obtain her citizenship through her father. I plan on going to stay with him till he finishes school and hoping to gain citizenship for myself in the future as it will now be needed. I am dont really understand how that will work, do I need a Visa to stay there, he is Florida at the moment. I am also looking at going to school there as well, and possibly work. Will I need some kind of Visa even though I am Canadian? I know that for me to become a US citizen I can only through naturalization. But what do I need to live there?

For him to sponsor you, you need to get married or plan to get married at least. The simplest way to go about it is to get married and then he sponsors you for entry on an I-130 (also requires other bits of paperwork after the petition is approved). You get an immigrant visa and enter the US. Also the quickest type of marriage-related visa to get, although it still takes the best part of a year.

I suppose you could go in as an F-1 student to attend college but you have to have "non-immigrant" intent and that would be hard to pull off with a US citizen boyfriend who is the father of your US citizen child.

If you did get in as F-1 (you get an I-20 from the school and apply for the status at a POE) you could get married and then apply for adjustment of status to permanent resident using I-485 and various other bits of paperwork, which are described at length on www.visajourney.com

Note that simply having a US citizen child doesn't really help you in any way in getting into the US. Helps the child, but not you, they can't sponsor you until they become an adult.

Check out visajourney.com, LOTS of info on RELATIONSHIP style visas. Checkout the K1, K3 and CR-1 forums. At the very top of those forums are stickies/guides on how to apply for each

K1 (finace visa, not married yet) is probbaly the fastest, but check out the +and - of it above.

K3 is becoming less desirable, as it takes about the same time as a CR-1 visa. Cr-1 is probably the "best" visa as it costs less in the long run, can work right away, no travel restrictions, BUT it does take close to a year to obtain. Check out the + and - link above. Keep in mind you CAN travel/visit the USA while the visa process is ongoing, BUT it is up to the Port of entry (POE) officer, so do bring ties to Canada IE apartment lease, letter from employer, etc etc. And yes some do get denied entry! I traveled monthly to DC from Halifax,never had a problem.

Is part of your plan to go down there before the baby is born and to have the baby there in the US? Do you have the money to cover the hospital bills if you do that? Your provincial healthcare will not cover you for delivery in the US, and the fees can be excrutiatingly high. If your boyfriend is only a student, I'm guessing he has little if any income, and no health insurance. You'd only be covered on his insurance if you were married and had legal presence in the US anyhow.

You'd be best off to deliver the baby in Canada, and then do the paperwork at the US consulate to get her US citizenship status (register birth abroad).

For yourself, Steven and flames have explained the visa process, and unfortunately, none of them are quick. You and the baby will be living in Canada for about a year waiting on your visa.

Ok I didnt think it would be this much of a process, to get Visa's and all that i mean I am canadian lol you'd think you can go anywhere on a passport. I am having the baby here, not in the states, my boyfriend is coming home at the end of march and will stay here till Sept he goes back in the fall. He always comes home in the summers and holidays. Our plan currently is for me to go with him to stay in florida from sept to spring, may or so than come home. I am not looking to move there for good as of now. Am i not allowed to just go and stay in Florida for a few months?

Also I got family in the states that are US citizens, can they sponsor?

you can go to visit for up to 6 months per year. You cannot work during that time at all, and you must still have ties to Canada plus cashy money to support your stay.
