Need a new TN to switch job within same Company?

Postby kevinlg on Tue May 20, 2008 1:59 pm

Wonder anyone know about this.
I am currently under TN as an Engineer.
I know if you get a new job at another company, a new TN is a must.

How about switching to a higher position and carry more duties than it was originally applied for @ the border? All is within the same company and same location, but of course higher pay and more duties added from the original. No change in the nature , still Electrical Engineer.

THanks

Yes you need to file an amended TN with USCIS since the nature of employment has changed. Not doing so can lead to big problems since this is something CIS considers material. They may even claim you failed to maintain status.

Raise in salary alone would not rise to the duty to amend, but CIS may ask how you can be earning more if the duties have not changed i.e. more responsibility/ more sophisticated work.
