Need advice on Canadian moving in w me in USA

Post Thu Dec 31, 2009 8:31 am

Dear CanucksAbroad! Greetings from Sunny South Florida! I need your help and advice please! I accidentally met a wondeful lady frm Toronto on line and we really hit it off. After 2 months of talking hours on end I flew her to Florida on December 1st 2009 and we spent 4 days and nights together. She went home :( and we talked for another month and she / we decided she wants to move in with me. She is a Canadian Citizen with a valid Passport.. no criminal record and no hidden agendas. (we have never even spoke the word marriage).

1st --> Will the short 4 day visit haave any bearing on whether she can return as soon as late January to stay with me? I am aware of some 6 month rule..she can only stay here 6 months? Then what happens? What should she say at the Canadian border upon her next entry to the USA? This time there will only be a one-way ticket to here...not round trip. Should she tell them the truth? She is going to live with an American guy for as long as possible within the laws allowed? What do we have to do if we are still in love after 6 months?

So many questions...sorry! This is a big isssue for her and I and we are aware that there are going to be some hurdles ahead. We have already jumped many hurdale and the miracle of our meeting tells us we have to move forward intelligently and become educated about what we are allowed NOT allowed to do.

Please help if you can anyone... this is possibly the most imporrtant relationship of my lofe and I want to make sure it is even possible.

Respectfully,
TOM

No. But the best she can do is merely visit you -- as a tourist, she cannot come down and live with you; she MUST maintain a fully-functionning residence in canada during her entire visit(s).

Each time she -- or any foreigner -- enters US as a tourist, the border agent sizes up the visitor for 4 things:
(a) are they really here to visit, or do they have other intentions;
(b) do they have sufficient tie and incentives in their own country to ensure that they will not try and stay permanently in US and will go back when they say;
(c) do they have sufficient funds to support themselves during their visit, so as not to be a risk that they will work illegally;
(d) are they truthful or evasive in the answers they give.

And that is merely to get in for a few months.

If you or she really intend to live together in US, it will have to be as a married couple, after following very strict immigration process.

Visajourney.com deals with marriage-based immigration better than here.

Ans--> Ok...thanks for this detailed response... that's good to know.. she does not plan on rescinding her Canadian citizenship at all... & she can easily fullfill the a -d requirements yoy so diligently listed...perhaps this is a trial period for her / us to see if we want to get marrried someday. I do not know right now. So she can "visit" me for up to 6 months? Where would she "live" during that 6 months? Obviously she will live with me... as a tourist / visitor...whatever...she has to stay somewhere! What MUST happen after that 6 months?

Why is it a factor that she must be very lonely or miserable to consider moving in with me after two months? Funny thing is she is a very beautiful happy woman who could have anyone she wants! I am also 24 years older than her! Have you ever met someone in your life that seemed like "the one"? Maybe not...sorry to hear that.. it is beyond our control that we feel like we are meant for each other. We have invested more than 300 hours of phone calls learning about each other to date...as well as the 4 day visit. We want to experience more.

Thanks for the "life advice" as well.

It has nothing to do with rescinding citizenship. Besides, citizenship is not a sufficient tie to canada.

Read over the 4 criteria, I would think -- if skillfully questionned -- she would fail the first 3, and be very tempted to fail the 4th.

Having a one-way ticket to go live with a potential 'soul-mate' is a sure signal to get denied entry.

But, save the "beyond our control" stuff for your facebook page. Stalkers say the same thing, btw.

Ok Mr or Miss Completely Negative and Way too Realistic. If I was to listen to your ardent advice 100%, her and I wold immediately say LET's FORGET THIS RELATIONSHIP and move on. I am looking for some positive input, but you seem to only want to point out the negatives. I am happy to know the negatives and am not naive enough to think there was not going to be any, however, we are not the first couple to be faced with this situation and won't be the last. I disagree with you about her failing the 4 criteria, as they didn't ask her these questions on her 1st visit...NONE OF THEM...they didn't want to know if she had a round trip ticket or otherwise. She DOES plan on answering truthfully as possible if questioned in depth, and her next VISIT is just that ...A VISIT. People deserve the chance to decide if they want to be married...where they live geographically should not be the obstacle that prevents that. So...if you do not haave anything positive to offer...please save the negatives for the next guy. Thanks for your time. I know there are many positive answers to our situation / problem and I will find them ww/o your help.

The unecessary "stalker" comment on your part only gives validation to the fact and proves my point that you are a miserable person and want others to be miserable with you...good luck trying to suck others into your black void of negativity...it won't work with me, and will not deter her and I from our plans.

Happy New Year

It's better that I be realistic and you know the problems than be surprised at the border when she gets banned for lying when she gets flustered at the officer.

Native yanks know zilch about their own immigration rules, and from your original post, that was pretty clear, too.

I obviously don't control what you do or how you feel. Heck, apparently you can't even do that. So don't get flustered, insulted or annoyed. But even if you do, just read what I say, look at visajourney.com and be more prepared.

This is not hearts and flowers territory.
