Need advice, under a TN1, can I accept consulting work?

Hi,

I have a TN1 with a company, but things are slow right now. Some other company offered me a part-time consulting engagement. I will get paid on hours billed. My current company is ok with it.

Will that be a problem with to my current TN1?

It would not jeopardize and have no effect upon your current TN. CBP gave clarification on this matter back in early April stating that additional concurrent TN work is fine but only part-time is acceptable.

As long as you are eligible under NAFTA and the employment is part-time, there should be no problem.

You would require a new TN for the position or a new I-94 indicating your new employer and occupation concurrent to your original I-94.

That doesn't sound as helpful as it may sound at first glance, why couldn't you have two "full-time" positions? I know at least one doctor who could be said to be in that position, he was on TN-1 in Atlanta. Have you got a link to it?

Anyway the answer to his question is that you can hold multiple TN-1s concurrently, and in fact it was designed to work that way because of e.g. doctors who consult at more than one hospital in the US.

Hmm, I can't see anything in the law or the regs that justifies that position, I can't see a method of enforcement either, much like with the "layoff" situation.
