Need I-20 advice

Post Fri Jun 05, 2009 9:29 pm

ah where to begin...

In 2006 I travelled to the U.S. for six months. Then re-entered in 2007 (September) for 3 months. When I tried to re-enter I made the mistake of getting driven in by a woman who was American ( who at the time I was dating and was pregnant with my child..she has since had an abortion and we have moved on our separate ways..but this was all recorded at the border ) without clearly stating what I was doing ( I said I was visiting a school without attending it..it didn't go over well ) I ended up flying in 2008 (Jan) without any problems. I stayed for another six months, then decided to travel Europe, Egypt and India.

I came back to Canada during the fall of '08 and attempted to enter the U.S. in January of '09 but I was refused for misrepresenting my employement status after a lengthy questioning period (I said I was employed at a local yoga studio when really I was free lancing) I wasn't barred because it was at a pre-check station in Ottawa but I was sent back.

Any ways, now I'm awaiting the arrival of my I-20 with the intent to study in the U.S. in the same town I frequently visited during my stays in the U.S.

I will be hiring a Lawyer to make sure the whole thing goes smoothly but she won't be back from vacation for another week and I'm curious what my chances are for a clear border process?

I'm paying rent, and will be keeping my room that I rent at my aunts house while I am studying. I also have been working at a movie theatre since I was refused in early '09. I have a Canadian bank account with a five digit figure in it as well + I am being sponsored by someone with well over the necessary amount in their account.

I guess I'm looking for any other kinds of useful ties I can create between now and the end of July...

My Father is buried in Ottawa - it is my home. As is my Grandfather.

I'm hoping it will be enough to prove I am sincere in returning to my home...

any help would be appreciated!!! thank you

It sounds like a pretty straightforward F-1 application other than the fact your entry record is a bit of a mess. Not sure what a lawyer brings to the process because it depends on what the CBP agent thinks at the time you apply at the POE. You do need residential ties to Canada, saying you live at your aunt's and you have proof you reside there would be enough I think.
