Newbie would love some advice on TN

Post Wed Oct 06, 2010 9:23 am

Hi Folks,
Im new to this site so please dont hurl newbie crap my way! lol

I need help and advice with my situation...

I am English but live in the US with a greencard.
My wonderful girlfriend is Canadian and lives in Victoria BC. We want to get married etc etc but first step is being together.

We are looking at a TN visa for her to come as a management consultant... before you all roll your eyes, we have done a lot of research and know that this is the minefield category thats as ambiguous as something thats very ambiguous!

She has a degree in psychology and recently went back to school to get a diploma in Human Resource and Business Management.

She has been looking at HR based jobs here in the US and has a good chance of getting a job for a medium sized company to manage their HR, but they will make the job title HR Management Consultant.
I also have a friend that wants to employ her for 1 hour per week as a consultant for his HR needs (but not manage it).

1)What are the chances of her being accepted into the US under the TN visa?

2)Can she hold two jobs? If so does she need 2 TN'S?

3)If she needs 2 TN's, does the second employer have to complete the I-129 form and if so, is that a $350 form or closer to $1000 with security / fraud checks?

4)Could she enter just on the 1 hour per week TN offer?

5)If we leave the country for vacation, does she need to file / interview for her TN visa each time we come back to the US?

6)If we plan to get married, should we keep this quiet from the border patrol?

Im sure we will have many follow up questions, but i would really appreciate some help and answers to this quicksand situation!

Oh, and long term goal is either to move back to canada in 2 - 3 years... or if she wants to stay in the US, I will have my citizenship by then and i will apply for her to become a resident alien as my spouse.

You know there is a better TN site, at
http://forums.immigration.com/forumdisp ... -TN-Status

but I'll give you short answers I would elaborate on at that borad:

1. As good as her petition.
2. She needs a TN for each job.
3. The employer can eithr file I-129 (~$300) but best is to go back to border, otherwise premium processing would be used, whic is $1000 or wait 3 months.
4. Yes, she could enter, but would be expected to continue to live in canada, which is nota requirement if one has a full-time TN. She should secure the "real" TN first.
5. No. She should simply be able to prove that the TN she has is still viable. Pay stub or swipe badge should suffice.
6. Yes, although because you are not citizen, she will not be accused of trying tio immigrate, since you cannot immediately sponser her for GC. You are not really in the picture, as the boyfriend, so don't get involved. She's a big girl.

Pleaee follow up at the real TN forum above.

As you stated yourself - you need to be quite careful with the Management Consultant category. As she now has a related certificate (and the Management Consultant category is one of the few TN categories which doesn't require a degree), her TN Visa letter(s) are going to be the most critical part of her application. When I went through the process a few weeks ago, I used the guide from tnvisasuccess.com. I used the Dictionary of Occupational Titles and corresponding job descriptions to ensure my tn visa letter was completely sound and the guide which I purchased also listed all the questions I was asked at the border so I knew what to do and say for the border interview. I recommend either using that guide or an immigration lawyer as it is a tricky category.
