Help with H1B/SSN timing for a homebuyer

Hello knowledgeable forum people! I've looked in other threads but haven't quite got my answers.

My wife and I are in Montreal, and we're moving to Texas for my job.
My employer is getting me an H1B with premium processing (I can expect it to take 1-1.5 months, they say).

We want to buy a house (we're hunting in April) and close it before July 1 to qualify for the First Time Homebuyers Tax Credit. ...

Canadians in the USA: I-94 Expiry

My TN Visa was issued for 3 year duration and was due to expire in 2012. My passport, however was due to expire in May 2010. When I left Canada last time US Customs wrote on my TN Visa in my passport that it expires on the same date as my passport. I have since renewed my Canadian passport.

My questions are -
1. Do I have to take a trip to Canada and when ...

Criminal records checks at the port of entry

Hi people,

I am a Canadian citizen (Canada passport holder), and I have recently been given an offer of admission to law school in the United States.

As far as my understanding goes, Canadian citizens are exempt from applying for an F-1 visa; we would however need the followings:

1) I-20 Certificate
2) SEVIS payment receipt
3) Proof of funds to support legal education
4) Proof of citizenship
5) Proof of ties to Canada

After ...

Stuttgart bound!

Firstly, realllyyy glad I found this website! I've read amazingly helpful posts, HOWEVER! Its a hard thing to find employment when your german is limited and your only in town for a few months in the summer. Any suggestions, hints, links? Anything will help! Or if anyone is looking for a young, english speaking Canadian university student with experience in the food service industry, child care or just a hard worker (currently working on getting ...

Filing Form 1040NR in a Dual Status Year

Greetings fellow Members,

I was hoping that some of our resident tax Gurus could answer the following questions.

I'm presently working in the US (PA) on a TN visa. I arrived on March 2009 and began work there immediately. Before that, I was working for a Canadina company for the first 80 or so days of 2009.

In beginning my tax return, I spoke to the IRS at their general phone no. and, while they ...

Different residencies for co-habitating spouses?

My wife and I are Canadian citizens currently residing in Canada (I'm employed, my wife is self-employed). We currently live in a Quebec dwelling owned by her parents (my in-laws, who live in the US) - this fact will matter in a moment.

I'm considering a 9-month teaching job at a university in Texas to begin in the fall, and we plan to hurry down there to buy a home (our first) before the $8k ...

TN Work Permit - contracting

Hello,

I was refused a TN work permit; given the reasoning that the company who would hire me can not sub-contract me to anyone else for work.

In my case, I was being hired by a Company A in US, and one of my job functions is to travel to Company A's client sites to get software requirements and then develop the solution. However the Immigration Officer said that this is not valid, as being ...

Yet Another Dual Status Question - Canadian return

This is a basic question but I can't seem to find a clear answer.

I filed in the US as dual status in 2008. Here are all the details in case it makes a difference:
- Canadian resident under Tax Treaty on F1 status until June 27 2008
- US resident for tax purposes until from June 28 2008 - TN status
- physically present in 355 days present with no "residential ties" to Canada ...

Getting TN, but flying from Antigua -> San Francisco?

I'll be getting a 3 year TN, but will be vacationing in the carribean first.
So I'll be flying from Antigua to Atlanta (a connecting flight) to San Francisco.

ANU -> ATL -> SFO

The problem is, I don't know where I will talk to the USCIS agents. I'm concerned I will have to do the TN process in Atlanta (my connecting flight), and will risk missing my flight.

Does anyone know where I will ...

More than one source of income while on a TN?

No one seems to know the precise answer to this: I am a TN holder with a regular W2 paycheck from my employer. My tax preparer says I can receive (passive) royalties from a book I wrote while on TN (it's being released in a few weeks) and also passive income on my blog from google ad sense, but I CAN NOT start a writing service or record teaching CDs and charge customers on the ...
