Qualifying education, but less than 3-year of experience

I have a BA from Canada and switched field of study in the US with a 2-year degree in interior design.

When do I switch from OPT to TN??

Hi, here's my current situation: I graduated last spring, and have been working since in Chicago with my OPT visa. My OPT doesn't expire until August (two months from now), however I've decided to leave this job early for another position. TN to H1B, Change of Status or Consular Process?

I'm currently in the USA in TN status. The same employer would like to petition me for H1B status (start date Oct 1, 2012).
The lawyer told me I have two options:
1. File I-129 H1B as Change of Status (COS). If approved, I will receive I-797 and I-94 in the mail. On Oct 1, 2012, I will automatically switch from TN to H1B. No action required on my part.
