NEXUS Application **DENIED**

I applied for a Nexus, I Am a Canadian currently living and working in the US under a L1A VISA.

I applied for a NEXUS card and was denied under the gorunds I do not meet basic requirements. I have a valid VISA, no criminal record and all of the informtaion I submitted was accurate and true.

When our managers applied for the L1 visa's, 3 were processed (including myself) at the Peace Bridge and were approved.

One was denied at Rainbow bridge for suspician of trying to enter the country on fraudualnt terms. Which was not true, the Border Agent was just a real goof.

This agent at that time has put a flag on the three of us who were already approved, which means being hauled into the back room every time we cross into the US. Which is really getting old. Pleading our case. Every time we get re interviewed, the agents seem quite baffled about the situation. Agree were are legit and send us on our way.

Could this flag have been the cause of my denial?
I was hoping getting the NEXUS would help improve my comings and goings.

And come next April when its time to renew, will the flag prevent us from an L1 extension?

Sorry for the long post, I am just really getting fed up with having to deal with this. Our POS lawyer is an idiot and is taking no action on our behalf. And that leaves me to try and sort all this mess out for our company. We need to bring more supervisors down here, but cannot as long as out operations has the flag.

As an added not.

I sent very detailed letters to CBP FOIA department requesting thier file on me. And I also sent another very detailed letter to Nexus Ombudsman asking for a review of my application.

Both letters contained Nexus Rejection letter, copies of my passport, depature record, notice of visa acceptance from USCIS, local USA drivers license, SSN, my business card, and a 3 page description with pictures of what we as a company do and what I do as a manager.

Has anybody here ever attempted something like this?

Look, nexus is for very clean people. You've been flagged, so now you will have to go through normal path.

I just found this online, took some digging and I am surprised I never heard of it before.

I doubt that this will do you much good. This is primarily for people with an unfortunate similarity in name, ie. "I'm not that Osama bin Laden"

After an unwarranted squat search, they obtain a TRIP number and subsequently quote their "redress number" when the TSA officers eyes bug out from behind the screen, and they pass through just before they snap on the rubber gloves

Oh well, at any rate. I filed for it. Will just see what happens.
I dont think it will do any damage to try. I know why the flag is there, they say we are suspected of entering the country under false pretences to obtain work visas. So I sent them about 2 pounds of paper. My I94, I797C, SSN, Local drivers license, letter from employer, pictures of our equipment, my business card, description of my job, etc. Even if they reject it, I will at least have the satisfaction of killing thier paper shredder. There is a phone number posted on thier website, says you can ask specific questions about your file. I am gonna give em a call and see what they say.

I am curious to see what the CBP FOIA sends me back.
I will post the results here as I get them, so others who may be in the same situation can have a better idea of the process. Fail or not.

I can handle the extra screening. My biggest fear is this flag will prevent me from renewing ny L1 in April. Thats why I am working so hard on it now.

Just an update

After applying to the office of the ombudsman, I was notified by the GOES system of a change of status to my account. My staus was changed from denied to conditionally approved.

So hopefuly I am on the right track. I am still waiting for an update to my redress request.

Just an update.

After all this time I have finally resolved this issue.
I am no longer being detained at the border and I was issued a NEXUS card.
