Nexus update - TN-1 status to H1B visa

Post Sun Sep 27, 2009 9:50 pm

Hi,

I have a few questions regarding Nexus update when I'll have my approved H1B kicks in on Oct 1, 2009.

Background:
I am a Canadian working in the States. My first TN-1 status ends on Sept 27, 2009, new approved TN-1 status starts on Sept 28, 2009, and approved H1B visa starts on Oct 1, 2009. My Nexus was applied with the first TN-1. I already have both I-94 of the new TN-1 and H1B, processed by mail.

I changed my address prior to application of new TN-1 and H1B using AR-11, so both application are using my new address. I also updated the US mailing address on Nexus site.

I have a valid US driver license, and I recently bought a car in the US as well.

I am planning to travel to Canada from October 2, 2009 (evening) to October 4, 2009 (evening). Since I would like to use my Nexus to cross both sides of borders, I believe I have to update my status info in the Nexus database on October 1, 2009 before my travel.

Questions:
- Any appointment needed at the enrollment center to update my status change? or could I just walk in? (I am planning to go to a non-border center)
- Other than the status update, do I still need to update my address again at interview/appointment?
- Could the Nexus officer prepare/staple my H1B I-94 to my Canadian passport right there while updating the Nexus info?
- anything else should I prepare? (e.g. my conveyance was a Canadian license plate car which I no longer use)

Thanks!

(I haven't read this board for awhile since my tax question last year, I am very glad that I still see many active helpers around, e.g. Steven, lawrlaws, etcetc :)

This procedure varies depending on the POE because at some POEs the NEXUS office is on one side of the border and at others there is only one POE and CBSA and CBP are in the same building.

But anyway the gist of it is that you need to get the status added to the NEXUS database.

Your status change is automatic because you have the I-94. Basically you just need to get them to update the database and that depends on the POE so call ahead. You might be able to do it on the way out, but more likely you will do it on the way in.

It doesn't need to be updated when you leave because you're a Canadian citizen so the Canadian side of the equation doesn't change, it's on the way in that you would need to get it added - but you might be able to get it done on the way out, which may be more convenient.

Just a few comments (my TN-1 ended the first week of Sept, and of course H1-B doesn't kick in until the 1st, so I just went through this).

When I went into the NEXUS office in Pearson without an appointment early september to drop off my I-94 (yes, I forgot) and to update my status since NEXUS thinks you're on expired travel documents, the officer actually tried to process the H1B. It didn't work, earliest is the 21st, she told me to come back into the office closer to Oct 1st and they'll take care of it.

When I returned on the 21st the Canadian officer wouldn't even pass me on to the US officers saying they don't do this and that I need to use the air crew lane, then to come back into the office next time I return date to update them.

BTW, first time ever using the air crew/handicap/nexus lane at Pearson, and the officer was less than happy about this. Only question was, and this was after he took the I797 and new I94 was a snarky "What? is the nexus machine broken or something?".. But, we've all seen far grumpier than that I'm sure :D
