Non Resident Status

Post Tue Jun 09, 2009 12:32 pm

Can anyone advise on what I can do to get my non-residency status? Canada Revenue is holding up my certificate and it's been over a little past 2 years. I have been advised to close bank accounts, which I did. I'm not a home owner. I can say I have to no ties what so ever with Canada, other than my passport. I have been told by Canada Revenue, they want proof of my marriage, earnings. When I opened my UK bank account. I submitted all of this before. And this is holding my private pension. I've made numerous phone calls, faxes etc. And don't know what to do! Although, they consider me a non resident, they have stopped child tax benefits, gst benefits. And they want money back!! Help before I fly over there!!!

Well you are non-resident unless they drag you into court which is going to be hard to do if you live abroad. Have you filed an NR-73?

Hi Steve, yes filled out a NR-73. 4 times. Now they want more information. I'm under the impression I need a non-resident certificate to get my money from the union. My old job in Canada. Their good at saying I owe them money, but when I want money back they take their time!!

Are you talking about the pension transfer form?

Do what I did and file a complaint FWIW. Took me two years to recover $70 of Part XIII tax, it was a farce.

There's no need to close bank accounts, whomever told you that was totally wrong, all you need to do is declare to the bank you're non-resident so it sounds as though it's time to file a complaint to me.

Have you written to them? The International Tax Office in Ottawa? I had the opposite problem. According to the CRA's rules, I am a deemed resident, however, they decided I was a non-resident and stated I owed them about $3,000. Took me 6 months to fight them and in the end, I got my status back, and they owed me $1400.
The form NR-73 is a farce.
From my dealings with the CRA, there is no such thing as a "non-resident certificate". One day they just sent me a Notice of Re-Assessment stating that I owed and was no longer considered a resident.
I have 4 bank accounts, 2 rrsp accounts, 3 credit cards, family ties...none of that mattered. The CRA reads it to their advantage.
Have you gone through the complaints process?
