Obtaining TN Status After Moving to the USA?

Hi, I'm Garson, glad to have found this forum :).

I moved to the USA from Vancouver about 6 months ago under TN status and work as a graphic designer in San Francisco. My girlfriend (also from Vancouver) now wants to move here and find a job. She has an undergraduate degree in psychology, so I believe there are a few jobs she could apply for that would also qualify for TN status (occupational therapist, recreational therapist, social worker).

So my questions are:

- When she crosses the border, what should she tell the border patrol? Because if she says she is going to live with me and look for work, wouldn't that bring up a bunch of red flags? Conversely, if she says she is coming on vacation, when she applies for TN status, will the statement of intent be an issue?

- Do employers in this field generally have any reservations about hiring people who are not currently permitted to work (it's extra paperwork I'd imagine)

- If she just wants to do volunteer work, does she still need a work visa?

- Are there many advantages to getting married and then having her come down? Where can I find more information about this?

There is a difference between lying and providing more information than is required. She is visiting the U.S. on vacation and will be staying with a friend (or boyfriend who is on TN). If she just says boyfriend they may think she may get married become american, etc.

2. Do employers in this field generally have any reservations about hiring people.?
Yes. Many employers do not know about the TN Visa. They know about the H1 and the hassles, costs involved. When a person can clearly explain the TN Application process and answer the employer's concerns - they will get the job.

I have another question.

Does she need to find a job before she comes over, or can she come here first, find a job and then apply for TN status?

She could come over as a visitor with the intention of visiting -- and if she finds a job while in the U.S. - that's great!
