Occupation Qualification (patent agent)

Hello,

I am currently a Canadian studying in the United States on a F1 Visa. I was wondering if anyone has any experience dealing with TN Visa as a technical advisor (or a patent agent). My occupation will require me to help file and prepare electronics related patents for the USPTO. I have been trying to locate a possible occupation in which this fits, but I am having a hard time pin-pointing. I have graduate engineering degrees, but I can't fit into the law occupation since I don't have my JD yet. Any help at all would be much appreciated.

Would the Engineer category work? I would recommend talking with an immigration attorney on this one. I work with patent agents on a daily basis but I don't know a lot about the immigration implications, as I got my current job post-GC. But if you can make the case that your skills as an Engineer are essential to this position, I would think it might fly. But since your daily duties will be a little different than might be typical if you actually worked for an Engineering firm, it might be good to talk to the attorney as to how to present your case. Since you aren't an attorney yourself yet, I assume you are being hired for your technical skills, not your law skills, so I'd think the Engineer category would work.

BTW I'd recommend eventually getting your JD in the field you are going into--but that is another matter.

Thank you for the advice. I didn't know lawyers have free consultations, I assumed everything would be billed lol.... Apparently, I can qualify for the technical publication writer occupation.

The job classification seems rather coarse and simplistic doesn't it. I'm a former patent examiner specializing in technology transfer and ip management. The position requires a minimum of a bachelor of science/engineering, intellectual property law training, contract law, and business development.

It's tough to figure out what to call yourself... engineering, legal, business analyst ...

A technical publication writer... lol... they never read a patent application.
