Offer from USA

Hi everyone,

Firstly, I want to thank everyone for contributing to the site; a lot of useful information.

Although I have learned a fair bit I have a question that is a bit more specific:

I am expecting an offer of employment from a company in the United States this week (permanant employment). They have told me that they will file me as a TN visa and later then apply for an H1B once I am in the country.

My concerns are as follows:

1. I have a CGA, Accountant, so I am on the NAFTA list; although my job title will be senior business analyst? Will this cause a problem?

2. My employment is permanant, but the TN Visa is for 1 year, I realize I can renew every year but does my employment letter have to state that its only for 1 year or can it say it is a permanant, full time position?

3. Intent -- My intent is not to move to the states permanantly as my parents and my place is in Canada but my intent much later in life might be moving to the states, MIGHT! . how do I deal with this during the interview?

4. Is there anything else that I need to take into consideeration when I look at the offer letter? . I am certain the company sponsoring me is fairly adept but I just want to make sure.

Under no circumstances give USCIS even the slightest impression that you are intending to reside permanently in the US, and ditto for the offer letter. A TN-1 is for Canadians and Mexicans to temporarily work in the US. Anything that indicates anything permanent will get your entry denied.

Then you're in the situation of trying to get an H-1B, which allows you to stay for three years, and you probably won't get it because there's a quota.

Also note that TN-1 is not a visa, it's an entry category, which is why you apply at the border with all your paperwork.

Then you're in the situation everyone else seems to be in that posts on here, renewing it every year and trying to convince USCIS for years on end that you are only "temporarily" working there.

Hi Steve

Thank you for your help. What worries me is this is my first venture into the united states and the offer is permanant, and employer said they have a full legal team with that has ties with border and immigration services. The company holds ties all across the world; curious how things will work out.

Any other thoughts? . I do own a home in Canada so that should be good right?
