On a TN Visa and got married

Hi,

I 'm currently working, and have been working in the US under a TN Visa for about 5 years. I met someone, and we got married. No steps have been taken yet to do a status change.

My question is: Can I pass the border and re-enter the US? Will I get into some problems because I got married? Do the border officers have this information.

The reason I think it could be a problem is because a TN visa is a temporary visa... if they know that I got married... will this make my intent not temporary?

You should NOT leave US until you have file I-130/I-485/I-765/I-131 AND have I-131 and I-765 approved or you will be denied entry and will not be allowed to work.

I hope you still have time on your TN, as it will take about 4 months before you will get all this done. Until then youcan still work on TN but cannot renew it and cannot enter US on it.

I do have a 3 year TN... so I have time. So the border officers do have this information? That I am married?

They can ask, and if they do you WILL be denied entry (and have to apply for a K visa or DCF), your TN will be pulled, and you will be stuck out of US for several months.

As soon as you married, you were supposed to begin the adjustment process ... so get going.

K3 is pretty much gone the way of the dodo bird! One can not DCF unless the American spouse has a legal right to be in Canada (not just as a visitor) Which pretty much leaves the CR-1 route!! Belive me, you want to AOS!!!!!!!!
