One visit or Two for TN and TDs?

Post Thu Aug 06, 2009 6:49 am

Hi again.
I think there is at least one CBP agent that is regularly on this forum, so I hopefully he/she will see and also respond.....

Basically, in the past I have worked in the US under an L1B, and TN (1yr validity) for two different employers. I am currently with a third employer with a TN that is about to expire. The third employer is wanting me to renew the TN.

Everytime I have come to the border to submit my application for TN, I have done so alone. I have not come with my dependants, nor applied for their TD's in that trip.

Is that the best way to go about it? Make a separate trip for the TD applications after my TN has been approved?

Its a pain in the a@@, but I have this feeling that if I show up with everyone to get my TN and the TD's then the chances of rejection for my TN are higher.... Although it would be much more convenient to odo everything in one trip --convenient for me, but not so for the particular CBP agent?

Well if you don't do it that way your dependents will have to apply for an extension on I-539 before their I-94s expire which is pretty expensive. And if you get denied, they are no longer entitled to their derivative status. Probably better to get denied all at once if you're really worried about it, they'll usually parole you in for a few days to collect your belongings.

You should always bring everyone. It's easier that way.

Brining the whole family is irrelevant to getting your TN. I have never seen or done otherwise.

If the Officer has a problem printing out three more I-94's, then it's time for him to retire. they take only a few more minutes.
