P-1 VISA Important Q.

Post Mon Jun 27, 2011 2:38 pm

Hi,
I have an important question regarding my application for a P-1 athlete's Visa. I am a professional wrestler that has been contracted by an American wrestling company, they are petitioning on behalf of my case. I've been sent a letter requesting more evidence from the INS because my contract states that I am a "performer" and since pro-wrestling is a "choreographed exhibition in which the outcome is predetermined" (as they put it) I am not eligible for the athletes visa because pro-wrestling is not a sport. I've been asked to submit evidence that proves I am an athlete.

Now here's my question, do I gather evidence that proves pro-wrestlers are in fact athletes? Certain states require me to get an athletic license in which to perform in said state. I train like a professional athlete. Or do I re-apply as an entertainer. Now the P-1 entertainer requirements state that I need to be a member of a performing group. Does the group also need to be foreign, or could the American company I'm contracted under count as the group in which I am a member of?

If anyone could help me out it would be greatly appreciated, I'm trying to do the right thing here by making sure I'm legal and I only have until July 8th to return the request for more evidence. Any advice and insight on providing some clarity on this matter would be greatly appreciated, thank-you so much!
