Possible job from us company

Post Wed Feb 17, 2010 1:10 pm

My situation is a bit different from others here, theres a good chance i might get a service technician job for a us company, i will still be based in canada but i will have extended travel in the states and internationally, the company has offices in Canada but they are different departments from the one i'm applying for in the us. Would it be possible for me to be paid in canadian dollars? If not, what kind of visa will i need to work in the us? I have lots of work experience but no college diploma for this technical field.

thanks for the info.

I'm not sure that you qualify for a TN given that you have no post secondary education. Your best bet would probably be to be hired as a canadian at the canadian office, work there for a year, and then use an L-1B visa to transfer over to the US office. You need to work at the canadian subsidiary for a year before qualifying for an L-1B.

I do have post secondary education, it's mechanical and electronics education related to the job but it's an attestation, not a diploma, also i will be working directly with engineers on a daily basis in the aerospace industry, i also have 6 years experience related to that job opportunity, could i apply for a technician TN ?

i could be wrong, but i do not think you can get a TN without a diploma/degree. you may want to check with an immigration lawyer, but i'm pretty sure this is the case.

miguelramosv, thanks for taking the time, so like you said, i believe my best bet would be to be put on the canadian payroll and receiving the work orders from the us side. does it mean i could be using a B1 visa for the first year unti i asked for the company transfer visa?

i am not sure that you "working" on a B1 for a year is legal and may jeopardize your L1B application in the future (again, check with an attorney about this)...

http://www.lawbench.com/ 50 bucks for 20 minutes.. probably money well spent.

I wasn't clear sorry, i would be doing contractual work a few times a year in the states, the rest would be international work. i would not be working constantly in the states, only on and off on different occasions.

check this out:

http://travel.state.gov/pdf/BusinessVisa.pdf

"
Engineer(s) install, service or repair commercial or industrial equipment or machinery sold by a non-US company to a U.S. buyer, when specifically required by the purchase contract.
Installation cannot include construction work, except for supervision or training of US workers to perform construction."

you may qualify as a service engineer B1 if the above is the case...........

suggest you consult with a lawyer though. guaranteed you'll be scrutinized on enter because it's going to "sound" like you're working. so you probably need to have documentation / letters drafted to show the nature of what you are doing adheres to the regulations associated to B1.

the last thing you want is to approach things half hazardly - saying the wrong thing may get you banned and will jeopardize your future L-1B.

Thanks a lot for the info! All i have to do is wait, this is a major multi-national company, they know what they are doing when it comes to foreigners, i'm crossing my fingers.
