Possible to Transfer a TN Visa?

Post Tue Jul 07, 2009 6:49 pm

Hi Everyone,

I'm currently working in the U.S. on a 3-year TN visa that was issued in November.

I'm considering leaving for a number of reasons including a paycut and the fact that (shockingly) I've had a few headhunters contact me with opportunities. But I don't want to extensively pursue anything until I know the following:

Is it possible to transfer the TN I am on to another company if the company is willing to temporarily employ me? I am guessing the answer is a resounding no, but I thought I'd see if anyone has had an experience with this?

I tried to do a search on here but don't have time to weed through the 91 results that came back, so hoping someone would know the answer.

Thanks in advance.

No, you can't "transfer" the TN. You need to get a completely new TN (assuming, of course, that the new job falls under one of the TN job categories). This means either another trip to the border or filing an I-129 with USCIS (which I wouldn't recommend since it costs more and takes longer).

You have to get another one, either at the POE or the new employer files an I-129 for you.
Steve.
