Hello.

We're planning for my girlfriend to move from Canada to the UK to live with me however there's numerous problems and logistical issues that I'm not clear on. We're under the understanding that a Working Holidaymaker Visa will allow her to stay here for 2 years (working for 1 of them) and then after that she can apply for an unmarried partners visa. That was the advice we were given last time, but I don't understand how that will work.

Apparently to apply for a WHM Visa, the person needs to be single (for some reason) so we need to consider ourselves as not together for some reason is this is to work. But that only allows her to be here 2 years, she won't have a paycheck or anything like that for at least a month (minimum) to prove that she's staying at the same address as me, so we won't be able to prove that we've been living together for 2 years to apply for the Unmarried Partners Visa. As I understand it, a lot of proof is required of co-habitation for them to accept the visa application, but how are we supposed to get that? If I have misinformation then I would welcome corrections. It's a lot of stuff to consider and so it's possible I've misinterpreted something. Further, if there is a better way to get my girlfriend over here for good then I'd also welcome that information.

Basically I would like clarification on the logistics of how to get her over here. I don't understand how we can do it based on the information I have. The 2 years of the WHM Visa won't all count because there'll be no way to prove she's been with me for all of it, so I don't understand what to do. So essentially if someone would be kind enough to walk me through the details I would be most appreciative. What I understand at the moment of the WHM and Unmarried Partners Visas basically add up to this route being one that won't work out.

based on the information u've given, the maximum of 2 years on whm visa and minimum of 2 years to obtain an unmarried partner visa (if these are correct) mean that u cannot successfully apply for the latter before ur gf must return to canada. it therefore appears that this is not a viable route.

Thanks for attempting to help.

We've asked on another forum though and actually got some useful information. Seems it could be possible to still get the unmarried partners visa as long as she gets her bank statements and phone bills forwarded to my address in England a month in advance before her arrival, so there is already a document stating she lives at my address when she arrives. Also there is another possibility with the youth mobility scheme route that is apparently coming into affect soon.

Yes, that is true, but according to the Boarder Agency website, she would NOT be allowed to change to another visa type. If she is on the WHM/YMV, then if you want her to have a common-law visa, she would have to go back to Canada, and apply for it there.

That's how I'm understanding it. They are being incredibly anal about it all now. I wish you all the luck in the world, because it's going to be very difficult with the new rules coming into place in November.
