pregnant and applying for tn status from F-1

Post Thu Oct 04, 2007 4:19 pm

I am an accountant just wrapping up my OPt (Dec 2007). My employer would like me to continue employment and since I missed the opportunity apply for my H1-B, I would like to apply for my tn status.

I have been trying to do research in order to answer my questions but these are the ones I have not found an answer to:

1. Will they give me a harder time at the border since I will be 5 months pregnant?
2. I lost my I-94 card, should I apply for another (send in the I-102) before going to the POE? (even though I won't get the new one in time)
3. Can I apply at the Ottawa airport 5 days before I go back to work, even though I am not flying out of there? (I am taking the bus across the Buffalo border because my passport is in processing and most likely will not be returned to me in time)
4. Would it be a bad idea to apply for an H1-B on April 1st of 2008. or should I just keep re-applying for a tn?

thanks so much for any help offered :)

It's really hard to get an H-1B, at least in recent years it is because more and more people keep applying for them and there's a quota. Plus it requires your employer to do more paperwork to support the application, so I'd say do the TN-1 if you fall into a NAFTA category.

Your other questions are more obscure, you need to talk to an FTO to get the TN-1, check and make sure the border post you go through has one on staff. http://naftalawfirm.com/page15.html

Check the CBP website as well, www.cbp.gov
